当事人可以通过和解或者调节解决合同争议。
The parties may resolve the contrat dispute by amicable settlement or adjustment.
当事人不愿意和解、调节或者和解、调节不成的，可以根据仲裁协议向仲裁机构申请仲裁。涉外合同的当事人可以根据仲裁协议向中国仲裁机构或者其他仲裁机构申请仲裁。当事人没有订立仲裁协议或者仲裁协议无效的，可以向法院提起诉讼。当事人应当严格履行发生法律效力的判决、裁定、调解书；拒不履行的，对方可以请求人民法院强制执行。
If neither party wants amicable settlement ， adjustment or if the amicable settlement ，adjustment fails they may apply to the the arbitration committee for arbitration. The party concerning with foreign affairs contract can according to arbitrate agreement submits it to the arbitration committee of China or other arbitration committee for arbitration. Where no arbitration agreement is stipulated or the arbitration agreement is void any party may prefer the suit in a people's court. The party concerned should strictly carry out the judgement ruling and reconciliation agreement which are legal in effect if the party concerned fails to implement the award the other party may apply to a people's court for execution.
在货物运抵目的港后，一旦发现货物之质量、数量和重量与合同规定不符，买方可以凭借双方同意的检查组织所出具的检验证书，向卖方索赔，但是，应由保险公司或航空公司负责的除外。有关质量不符的索赔应由买方在货物到港后30天内提出；有关数量和质量不符的索赔应在货物到港后的15天内提出。卖方应在收到索赔要求后的30天内回复买方。
After the goods arrive at the port of destinationonce the quality or quantity or weight does not conform to the contractthe buyer may rely on the inspection certificate issued by a consensual inspection organization to lodge claims with the bargainor but with the exception of what are responsible by the insurance company or the airline. Claims for the quality which do not not agrees with request must be put forward within30 days after arrival of the goods; Claims for the quality and quantity which do not not agrees with request must be put forward within15 days after arrival of the goods.The bargainor must restore the buyer with 30 days afer receipt of the claims. 信息条形码:1096366571335286 |
